Jharkhand HC Rules: In Rural Areas, Panchayat Powers Override JRDA

Jharkhand News : The Jharkhand High Court has taken a stern stand in the illegal land allotment and registration case inside the campus of Rajendra Institute of Medical Sciences (RIMS). The court has directed the state government to fix accountability of all officials involved in the scam and ordered registration of FIRs against responsible officers.

The division bench comprising Chief Justice Tarlok Singh Chauhan and Justice Sujit Narayan Prasad, while hearing a Public Interest Litigation (PIL) filed by Jyoti Sharma, also directed that compensation be paid to victims who were unlawfully evicted and harassed due to illegal actions of officials and builders.

In its order dated December 20, the High Court observed that revenue and registration officials failed to exercise due diligence while registering land that belonged to RIMS. Due to their negligence, several individuals were displaced from land that had already been acquired for the medical institute.

The court expressed serious concern over the fact that construction activities continued for years within the RIMS campus, yet the hospital administration remained silent. The PIL, filed in 2018, revealed that RIMS never informed the court about encroachments on its land.

The issue came to light after an investigation conducted by the Jharkhand Legal Services Authority, following court directions, found that nearly 7 acres of RIMS land had been illegally occupied.

Subsequently, on December 3, the High Court ordered the district administration to remove all illegal encroachments within 72 hours. Acting on the directive, the administration launched a demolition drive against illegal structures built on RIMS land.

The court also noted that despite having access to revenue records, officials failed to act. Title deeds were allegedly altered repeatedly in favor of private parties, and manipulation of rent receipts, revenue records, and no-dues certificates was carried out.

The High Court has fixed the next hearing for January 6, 2026.
