According to CBS News Channel news, District Judge Frimpong wrote in the decision, “ICE is violating the Fourth Amendment of the Constitution of the United States.” The judge determined that federal agents cannot arrest without solid evidence.
The ACLU and immigrant rights groups claimed in the legal document that federal agents are arresting people on the basis of racism. They are conducting raids without warrants. People are not allowed to seek legal advice. Federal agents are openly violating the Constitution.
ACLU lawyer Mohammad Tajsar said, “No matter what their skin color, what language they speak or where they work, everyone has constitutional rights to protect them from unlawful detention.” However, Trump administration lawyers denied these claims during the trial.
The US Justice Department did not comment on whether the federal government would appeal the decision. US Attorney Bill Espley said in a post after the decision that “federal agents will continue to enforce the law and follow the US Constitution. We strongly disagree with the allegations made in the lawsuit. We believe that agents have never detained a person without proper legal justification.” On this decision, California Governor Gavin Newsom said, “Justice prevailed today. The court’s decision has temporarily stopped federal immigration officials from violating people’s rights and racial discrimination.” It is reported that federal judge Frimpong has issued two temporary restraining orders.
Note that Judge Frimpong was appointed by former President Biden. Frimpong strongly criticized the Trump administration in his decision. Frimpong wrote in the decision, “Patrol patrols without suspicion violate the Fourth Amendment of the Constitution and denying access to lawyers violates the Fifth Amendment of the Constitution.”
At the center of this case is Brian Gavidia, a Montebello resident, who was detained by immigration agents last month. Gavidia said outside the court in Los Angeles on Thursday, “Even after I stated and proved that I am an American, the agents took away my phone.”
