Bihar Court Issues Non-Bailable Warrants Against 12 Policemen, Including DSP

Bihar News : A court in Bihar has issued non-bailable arrest warrants against 12 police personnel, including a Deputy Superintendent of Police (DSP) and a station house officer (SHO), for repeatedly failing to appear in court as witnesses.

The action was taken by the Special NDPS Court-2 judge Narendra Pal Singh, who ordered that all the accused policemen be arrested and produced before the court on March 9.

Court warns against ignoring judicial summons

The court observed that the absence of witnesses hampers judicial proceedings and delays the disposal of cases. It also emphasized that no one is above the law, and strict action will be taken against those who ignore court orders.

Policemen ignored repeated summons

According to court records, the police personnel had been issued multiple summons in two separate cases, directing them to appear as witnesses. Despite repeated notices, they failed to appear before the court, prompting the judge to issue non-bailable warrants.

Case 1: Arrest with illegal weapon and drugs

The first case relates to an incident from the Kudhani police station area, where a man named Roshan Kumar was arrested about four years ago near Garhua Chowk. Police had reportedly recovered a loaded country-made pistol and 1.920 mg of smack from him.

Although a charge sheet was filed in the case, the trial could not progress because the police witnesses did not appear. The court has issued warrants against several officials, including the then Kudhani SHO Arvind Paswan, former DSP Bipin Narayan Sharma, investigating officer Vivekanand Singh, ASI Prakash Kumar, and two home guards.

Case 2: Interstate ATM fraud gang

The second case dates back to August 2020, when police busted an interstate ATM fraud gang in the Sadar police station area’s Khabra Bhel Colony.

During the raid, police reportedly seized one kilogram of charas, an ATM cloning machine, and cash from the accused. However, even after five years, police witnesses failed to appear in court. As a result, the judge issued non-bailable warrants against six policemen involved in the case.

Impact on judicial process

The court stressed that such negligence by law enforcement officials seriously affects the justice delivery system, delaying trials and weakening prosecution cases. Authorities have now been directed to ensure the accused officers are presented before the court without delay.
